On February 28, 2023 the European Data Protection Board (which gathers all EU data protection authorities), released its non-binding opinion (Opinion 5/2023) on the European Commission Draft Implementing Decision on the adequate protection of personal data under the EU-US Data Privacy Framework.
The EDPB welcomed what it called “substantial improvements” to the previously existing framework (such as for example the adoption of a redress mechanism for EU individuals or the implementation of the requirement of necessity and proportionality for the US intelligence gathering data).
Yet, it expressed a number of concerns and requested some clarifications on a number of issues, urging the Commission to address those concerns and to provide the requested clarifications in order to solidify the grounds for the Draft Decision and to ensure a close monitoring of the concrete implementation of this new legal framework.
